1. Agreement to Terms

By accessing and using the ATL.REP website (atlrep.com) and booking our real estate photography services, you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.

2. Service Description

ATL.REP provides professional real estate photography services including interior photography, exterior photography, drone/aerial photography, twilight photography, and video services. Services are available to residential, commercial, and luxury properties throughout Metro Atlanta and Northeast Georgia within a 25-mile radius of our base location.

All services are customizable based on client needs and package selection. Specific deliverables and timelines will be outlined in your service agreement or invoice.

3. Booking and Payment Terms

3.1 Booking Process

To book our services, you must complete the booking process through our website or contact us directly. A booking is confirmed only when you receive written confirmation from ATL.REP via email.

3.2 Payment

Payment is required to secure your booking. We accept payment through our online booking portal. The full service fee must be paid before the scheduled photography session unless other arrangements have been made in writing.

3.3 Pricing

Pricing is based on the selected package and any add-on services. Prices are subject to change without notice, but quoted prices are guaranteed for 30 days from the quote date. Travel fees may apply for properties beyond 25 miles from our base location.

4. Cancellation and Rescheduling Policy

4.1 Client Cancellations

• More than 14 days before shoot: Full refund minus 10% administrative fee
• 7-14 days before shoot: 50% refund of service fee
• Less than 7 days before shoot: No refund; payment is forfeited

4.2 Rescheduling

Clients may reschedule their photography session up to 7 days before the scheduled date without penalty. Rescheduling requests made within 7 days of the shoot date may incur a $50 rescheduling fee.

4.3 ATL.REP Cancellations

If ATL.REP must cancel a scheduled shoot due to weather, equipment failure, or other unforeseen circumstances, we will notify you as soon as possible and offer to reschedule at no additional cost. If rescheduling is not possible, a full refund will be issued.

5. Intellectual Property Rights

5.1 Ownership of Photographs

All original photographs and videos created by ATL.REP remain the intellectual property of ATL.REP. Clients receive a limited license to use the edited images for the purpose of marketing and selling the property.

5.2 Client Usage Rights

Clients may use the provided photographs and videos for:

• Real estate listing purposes (MLS, websites, social media)
• Marketing and promotional materials for the property
• Real estate agent portfolios and marketing

Clients may not use the images for commercial purposes, resale, or any use other than marketing the specific property photographed without written permission from ATL.REP.

5.3 Portfolio and Marketing Use

ATL.REP retains the right to use photographs and videos in our portfolio, website, social media, and marketing materials to showcase our work. Clients may request that specific images not be used in our portfolio at the time of booking.

6. Client Responsibilities

Clients agree to:

• Provide accurate property address and access instructions
• Ensure the property is accessible and safe for photography
• Disclose any hazardous conditions or restrictions
• Provide necessary keys, codes, or access arrangements
• Ensure the property is clean and staged appropriately
• Provide accurate contact information for communication

7. Liability and Disclaimers

7.1 Property Damage

ATL.REP takes reasonable precautions to avoid damaging property during photography sessions. However, ATL.REP is not responsible for any damage to the property, fixtures, or furnishings that may occur during the photography session. Clients are responsible for any property damage caused by their own negligence or failure to disclose hazardous conditions.

7.2 Weather and Natural Conditions

ATL.REP is not responsible for weather conditions, natural lighting, or other environmental factors that may affect photograph quality. We will make reasonable efforts to work around weather conditions, but extreme weather may result in rescheduling or cancellation.

7.3 Limitation of Liability

ATL.REP's total liability for any claims arising from these Terms of Service shall not exceed the amount paid by the client for services. ATL.REP is not liable for any indirect, incidental, special, or consequential damages.

8. Delivery Timeline

Standard delivery of edited photographs is 24-48 hours after the photography session. Rush delivery options may be available for an additional fee. Delivery timelines may be extended due to unforeseen circumstances, technical issues, or high volume of bookings.

9. Dispute Resolution

Any disputes arising from these Terms of Service or services provided shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with Georgia law.

10. Modifications to Terms

ATL.REP reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Continued use of our services following such changes constitutes acceptance of the updated Terms of Service.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.
